PLEASE READ THESE TERMS CAREFULLY BEFORE ACCESSING OR USING THE PLATFORM. BY CREATING AN ACCOUNT, POSTING A LISTING, OR BROWSING MEGAPOLISMARKET, YOU AGREE TO BE BOUND BY THESE TERMS OF SERVICE.

MegapolisMarket (the "Platform", "we", "us") is a hyperlocal online marketplace that helps users list and discover products, services, jobs, properties, and other local opportunities. These Terms of Service, governed by the laws of India, form a binding agreement between you ("User", "you") and MegapolisMarket.

Acceptance of Terms

In compliance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, you must follow these Terms and our Community Guidelines, Prohibited Items Policy, and Privacy Policy. Breaches may result in content removal, feature restrictions, suspension, or permanent termination of your account.

Description of Service and Intermediary Role

MegapolisMarket operates strictly as an intermediary marketplace under the Information Technology Act, 2000.

• No contractual privity: We are not a party to agreements or payments made directly between users unless explicitly stated for a paid Platform feature purchased from MegapolisMarket.
• No control over listings: We do not own, physically inspect, or guarantee the quality, safety, lawfulness, authenticity, or availability of any item, property, job posting, or service listed on the Platform.
• Assumption of risk: Exchanges of goods, services, or money between users are undertaken at your own discretion and risk. You must independently verify listings, sellers, buyers, and payment methods.

Listings may be reviewed by our team before or after publication. Approval or removal of a listing does not constitute an endorsement of its accuracy or legality.

User Eligibility and Conduct

Age restriction

The Platform is for users who can form legally binding contracts under the Indian Contract Act, 1872. You must be at least 18 years of age to register or transact. We do not knowingly permit use by minors.

Account registration

Registration requires your name, email address, mobile number, and a password. Sign-in is by email and password. We may require email verification via a one-time security code before you can use certain features such as posting listings. You are responsible for keeping your login credentials and verification codes confidential.

Prohibited information and content

You agree that all listing descriptions, images, prices, and details are accurate and reflect the actual item or offering. You must not post, upload, transmit, or share content that:

1. Belongs to another person without legal right or authority

2. Is defamatory, obscene, pornographic, invasive of privacy, harassing, hateful, or discriminatory on the basis of gender, religion, caste, ethnicity, or other protected characteristics

3. Infringes any patent, trademark, copyright, or other intellectual property right

4. Is false, misleading, fraudulent, or intended to deceive other users

5. Threatens public order, the security or sovereignty of India, or incites unlawful activity

6. Contains malware, viruses, or code designed to disrupt the Platform

Guidelines for Hyperlocal Listings

MegapolisMarket supports categories including Electronics, Vehicles, Properties, Jobs, Services, Fashion, Furniture, and others. Category-specific expectations include:

Products, electronics, and mobiles

Sellers should describe condition, specifications, and defects honestly. Where applicable, electronics and appliances should comply with applicable Indian safety standards. Buyers should inspect items and verify identifiers (such as IMEI numbers for mobiles) in person before paying.

Properties (real estate)

Property listings must comply with applicable law, including the Real Estate (Regulation and Development) Act, 2016 (RERA) and local municipal rules where relevant. MegapolisMarket does not verify title, occupancy certificates, or ownership documents. Buyers must conduct independent legal and physical due diligence.

Jobs and services

Job and service listings must be truthful and comply with applicable labour and consumer protection laws. Misleading recruitment offers, interview fees, advance-payment scams, or bait-and-switch practices are prohibited and may result in permanent account termination.

General listing rules

• Only post items or offerings you intend to sell or provide — "want to buy" or "looking for" ads are not supported
• Select the correct category and locality text for your listing
• Do not post duplicate, spam, or misleading listings
• Contact buyers and sellers through email, phone, or WhatsApp only where you have chosen to share those details — MegapolisMarket does not provide a separate in-app chat inbox

Intellectual Property Rights

Other than content you submit (listing text, photos, and similar user materials), the Platform layout, software, trademarks, logos, graphics, and underlying code are owned by or licensed to MegapolisMarket. You may not scrape, copy, reverse engineer, or commercially exploit Platform infrastructure without written permission.

You retain ownership of content you post but grant MegapolisMarket a non-exclusive, royalty-free licence to display, host, promote, and distribute it for marketplace operation. We may remove content that violates these Terms or applicable law.

Privacy and Security Safeguards

Your personal data is handled as described in our Privacy Policy.

• Credentials and payments: MegapolisMarket will never ask for your password, bank PIN, or verification codes by phone or chat. Never share OTPs, UPI PINs, or passwords with other users or anyone claiming to represent us.
• QR codes: Do not scan unknown QR codes sent by other users to receive payments.
• Cookies and sessions: We use cookies and similar technologies to maintain secure sessions, remember preferences, and improve Platform performance. Hyperlocal discovery is based on locality information you enter, not continuous GPS tracking on the website.

Paid Platform Services

Optional paid features (such as featured listings or promotional packages) may be offered from time to time. Fees and validity periods are shown at purchase. See our Refund Policy for applicable rules.

Limitation of Liability and Warranties

THE PLATFORM AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS TO THE MAXIMUM EXTENT PERMITTED BY LAW. MEGAPOLISMARKET DISCLAIMS WARRANTIES REGARDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR UNINTERRUPTED AVAILABILITY.

TO THE FULLEST EXTENT PERMITTED BY INDIAN LAW, MEGAPOLISMARKET IS NOT LIABLE FOR USER CONDUCT, TRANSACTION OUTCOMES, OFF-PLATFORM COMMUNICATIONS (INCLUDING WHATSAPP, PHONE, OR EMAIL), FRAUD BY OTHER USERS, PHYSICAL HARM ARISING FROM IN-PERSON MEETINGS, OR INDIRECT OR CONSEQUENTIAL DAMAGES. WHERE LIABILITY CANNOT BE EXCLUDED, IT IS LIMITED TO FEES YOU PAID TO MEGAPOLISMARKET FOR PLATFORM SERVICES IN THE TWELVE MONTHS PRECEDING THE CLAIM.

Nothing in these Terms limits rights you may have under the Consumer Protection Act, 2019 where applicable to Platform services you purchase directly from MegapolisMarket.

Suspension and Termination

We may warn, restrict, suspend, or permanently terminate accounts that violate these Terms, our policies, or applicable law. You may close your account using Delete Account in the mobile app or by contacting legal@megapolismarket.com or grievance@megapolismarket.com.

Dispute Resolution and Governing Law

These Terms are governed by the laws of India. Disputes between users should first be addressed directly between the parties. MegapolisMarket may assist through our grievance process but is not obligated to resolve private peer-to-peer transaction disputes.

Disputes between you and MegapolisMarket that cannot be resolved through customer support within fifteen (15) days may be referred to binding arbitration in India, under the Arbitration and Conciliation Act, 1996, subject to applicable law.

Changes to These Terms

We may update these Terms to reflect legal, technical, or business changes. Material updates will be posted on the Platform. Continued use after the effective date constitutes acceptance unless prohibited by law.
